最近立法院擴權的事情,用我的觀點去做一點分析整理。

最近立法院擴權的事情,雖然我沒有去現場,不過還是很關心。
在網路上資訊非常的龐雜,作為太陽花學運時代的公民記者之一,
我想還是用我的觀點去做一點分析整理好了。
我覺得其實事情並沒有那麼複雜,就是立法院如果不斷擴權的話,
它就會打破所謂的「三權分立」的一個民主基礎。
那麼因為台灣就是一個民主國家,「依法行政」是一個很重要的原則。
所以法律如果被修改得很破碎,或者是給行政的團隊處處制肘,
或者是要把許多的資料釋出給對岸的話,那麼當然對台灣的民主跟安全是相當不利的。
這個事情很單純,但是立法院現在目前透過過半數的成員可以強行通過各式各樣的法案,
可以去修未來說不定選舉罷免法或者是反滲透法,這些都可以修改。
暫時它只是現在只是要擴充地方預算,那未來可能會有更多想要擴充的東西。
消減總統權力或者是要行政團隊不得反質詢,這些可能都還是相對的小事。
但是這種事情是像滾雪球一樣,走近了一步之後它就可以往下走更多的一步。
所以,目前看起來,我是覺得在場外參與街頭運動的人,是非常勇敢而且很有力量的。
實際上能不能夠動搖立法院呢?在程序上可能沒有辦法,但是在輿論上當然有機會是可以創造出新的輿論,去讓大家知道這個事情的嚴重性。
那麼在程序上面,在我們國家至少還有「憲法」可以支撐。
憲法高於一般法律,一般法律高於判例,這個是法律的基本原則之一。
所以至少中華民國憲法還是我們可以信賴的最後防線。
那憲法要修就不是過半數的人就可以決定的,不是過半數的立委就可以決定的。
所以至少他們現在還沒有辦法去修憲。
所以如果等到大法官釋憲,然後去說明說有一些立法是不合理的,不合憲法的,立院法的事情還是會有一個煞車,不至於無限制的延燒。
所以我想大家也不需要那麼的焦慮。
以上是我簡單的評估跟分析,所以過好自己的生活,然後關心時事。我想這就是目前的想法。

我覺得這個事情跟特定政黨的支持與否已經無關了,也跟二元對立沒有什麼關係。
這個事情就是一個非常非常單純的一個事件,然後跟對岸的操作很明顯的是有關聯的。
這個事情國外的媒體也都看得很清楚,國內的媒體我相信也是各自有各自的立場。
但是這個事情我想大家眼睛都是雪亮的。
至少,台灣目前還是一個有言論自由的國家,每個人都還是有權利公開的發表他的意見。
希望所有島上的人,不分黨派,都可以珍惜這個言論自由。
